Terms of Service

These terms apply when you access or use Kiwi Campervan Alerts ("the service"). By creating an account, starting a trial, purchasing a subscription, or using the service, you agree to these terms and our Privacy Policy.
1. Alert service only
We provide software that identifies, organises, matches, and sends links to campervan listings published by third parties. We are not a marketplace, vehicle dealer, broker, seller, buyer, agent, auctioneer, inspector, lender, insurer, payment provider, or escrow service. We do not take part in or earn a commission from a vehicle transaction unless we clearly tell you otherwise.
2. Third-party listings and intellectual property
Listing text, photos, trademarks, and other third-party material remain the property of their respective owners. We do not claim copyright or ownership in that material. The service may process and display limited listing information, excerpts, images, and links so users can identify a listing, assess whether it may match their preferences, and visit the original source.
We are not affiliated with or endorsed by a marketplace, seller, manufacturer, or other third party merely because its content or link appears in the service. A rights holder can contact hello@campervanalerts.nz about content it believes should be corrected or removed.
3. Listings are not verified
We do not inspect vehicles or verify sellers, ownership, price, availability, location, condition, mileage, finance owing, registration, Warrant or Certificate of Fitness, self-containment status, roadworthiness, legality, safety, or the accuracy and completeness of a listing. Automated extraction, matching, deduplication, summaries, price estimates, and vehicle checks can be incomplete or wrong. Nothing in the service is vehicle, legal, financial, safety, or investment advice.
4. Your due diligence and transactions
You are solely responsible for deciding whether to contact a seller or enter a transaction. Before paying or committing, inspect the vehicle in person, confirm the seller's identity and authority to sell, check the plate and VIN, obtain independent mechanical and specialist advice, check official records and security interests, review original documents, and use a secure payment process. You deal directly with third parties at your own risk, under any terms that apply on their platform.
5. Coverage and availability
Marketplace coverage can change without notice. We do not promise complete coverage, a particular number of listings, or that an alert will be accurate, unique, available, or delivered within a particular time. Listings can be delayed, missed, duplicated, changed, removed, or sold before you see them. We may modify, suspend, or discontinue a source or part of the service for legal, technical, commercial, safety, or operational reasons.
6. Accounts and acceptable use
You must provide accurate account information and protect access to your email and account. You may use the service for your own lawful campervan search. You must not scrape, bulk-copy, republish, resell, sublicense, reverse engineer, interfere with, overload, evade access controls on, or use the service or third-party listing content to violate another person's rights or any law. We may restrict or terminate access where reasonably necessary to protect users, third parties, or the service.
7. Trials, subscriptions, and cancellation
Current plan prices, trial length, alert frequency, and billing period are shown before checkout. Unless you cancel before a trial ends, the selected paid subscription begins and renews automatically for the stated billing period. A specialist payment provider processes payments. You can cancel through the billing portal; cancellation takes effect at the end of the current billing period unless the law requires otherwise. Fees already charged are not refundable merely because you did not use the service, but this does not limit any refund or remedy required by law.
8. Third-party services
The service links to and relies on third-party websites and providers. Their availability, content, security, privacy practices, and terms are outside our control. A link or integration is not a warranty or endorsement. You should review the original listing and the applicable third-party terms before acting.
9. Liability
Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded, including applicable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986. Subject to those rights, and to the maximum extent permitted by law, we are not liable for a third-party listing, seller, vehicle, transaction, payment, fraud, injury, property damage, lost opportunity, missed or delayed alert, or third-party service, or for indirect, consequential, special, or punitive loss.
To the maximum extent permitted by law, our total liability arising from the service is limited to the subscription fees you paid us in the three months before the event giving rise to the claim. This limit does not apply to fraud, wilful misconduct, or any liability that cannot lawfully be limited.
10. Changes and governing law
We may update these terms as the service changes. If a change materially affects current paid subscribers, we will provide reasonable notice and any cancellation right required by law. These terms are governed by New Zealand law, and New Zealand courts have non-exclusive jurisdiction.
